Respondent was charged with having failed to hold property belonging to the law firm which employed him separate from his own, failed to promptly notify the law firm of his receipt of that property and failed to promptly deliver it to the firm, as well as having engaged in conduct involving dishonesty, fraud, deceit or misrepresentation.
In the course of representing two separate clients in matters in which Respondent had agreed to pay to the firm one-half of any fees received and all costs advanced, Respondent intentionally failed to remit the fees and costs and intentionally misled the firm as to status of each case. Respondent also failed to maintain those funds in a separate account by his use of that money for his own purposes. |
