Formerly admitted attorney who had been disbarred on consent in 1985 for misappropriation of client funds, made his second application for reinstatement to the bar and the Office of Disciplinary Counsel (ODC) opposed readmission. ODC opposed reinstatement based on the formerly admitted attorney’s use of employee withholding tax funds to pay personal expenses because of personal financial difficulties during his period of disbarment and a number of years prior to his second application.
The formerly admitted attorney argued that he had been rehabilitated and offered evidence which included: compliance with continuing legal education requirements; achieving a LLM degree in taxation; and positive character testimony FROM a number of witnesses.
The Board found that the attorney had met his burden of proving that he was fit for readmission to the bar and recommended reinstatement. |
