This was a criminal conviction case. Respondent visited a co-defendant in jail and attempted to have the co-defendant agree to and perpetrate a false story to the government to gain sentencing favor for the co-defendant and Respondent’s client. Respondent was convicted of one count of conspiracy to tamper with a witness, in violation of 18 U.S.C. Section 371; and two counts of witness tampering and aiding and abetting, in violation of 18 U.S.C. Section 1512(b)(1) and (2).Respondent opposed a temporary suspension and the Supreme Court did not suspend him. The majority of the Hearing Committee recommended a five year suspension, retroactive to April 14, 2009, the date of the disciplinary hearing. The dissenting member recommended a five year suspension retroactive to August 7, 2007, the date of the first pre-hearing conference. ODC recommended disbarment or a lengthy suspension and no retroactivity. The Disciplinary Board recommended a five year suspension retroactive to April 14, 2009. |
