Although Respondent placed his mental health at issue at the time of the disciplinary hearing, he failed to meet his burden pursuant to Braun.
Although Respondent took no action to dissolve his temporary suspension and the Disciplinary Board recommended a two year suspension for Respondent's failure to observe his fiduciary responsibility and noted that the Board's recommendation had no bearing on the temporary suspension which was not before the Board, the Supreme Court imposed a three year suspension on Respondent retroactive to the effective date of his temporary suspension under Rule 208(f)(5), Pa.R.D.E.
