| Case Digest |
Respondent was originally scheduled to receive an Informal Admonition as the result of her failure to act diligently, by not timely filing a request for a trial de novo, and failure to communicate effectively with the client in a divorce matter. Respondent failed to appear for the Informal Admonition and as a result Chief Disciplinary Counsel sent Respondent a letter informing Respondent to show good cause for her failure to appear. Respondent did not reply. In a second matter, Respondent represented another client in a divorce matter but failed to communicate with the client over a period of one year, for which she was terminated. The client sued Respondent for a return of fees paid to her but despite the lawsuit against her, Respondent failed to withdraw her appearance on behalf of the client in the divorce matter.
Respondent was not involved in the disciplinary proceeding as she failed to: 1) attend the scheduled Informal Admonition; 2) respond to CDC’s show cause letter; 3) respond to the petition for discipline; 4) attend the prehearing conference and disciplinary hearing; and 5) file briefs with either the Hearing Committee or Disciplinary Board.

| Discipline Imposed |
Suspension for one year and one day |
| Points of Law |
Respondent’s misconduct coupled with her willful failure to appear for an Informal Admonition and case precedence indicates that a suspension of one year and one day is appropriate. “The reason for a suspension requiring a petition for reinstatement is not the actual client misconduct, but the respondent’s absolute failure to acknowledge the disciplinary proceedings and participate in them.” |
