This was a reciprocal disciplinary action based upon Respondent’s three-month suspension in New Jersey by Order dated December 11, 2009, for violations of New Jersey Rules of Professional Conduct 1.4(b), failure to advise his client that Respondent had left his former law firm, 1.5(b), failure to communicate in writing the basis or rate of Respondent’s fee, and 1.8(a), failure to advise his client to seek the advice of independent counsel relative to a personal loan of $3,000 to Respondent. Respondent had a prior record including a year and a day suspension in Pennsylvania by Order dated July 10, 2002 (No. 53 DB 2000), a year suspension in New Jersey by Order dated September 4, 2003, and a reciprocal suspension of a year in Pennsylvania by Order dated April 23, 2004 (No. 69 DB 2004). Respondent had not been reinstated in either Pennsylvania or New Jersey. Respondent did not report his New Jersey three-month suspension to Pennsylvania. |
