Convoluted prosecution as a result of Respondent’s DUI conviction in 1995, aggravated by previous ARD for DUI, nol prossed reckless endangerment charge, and unresolved marijuana possession charge. Respondent suffered from major depression and drug use. Despite recommendation by Disciplinary Counsel and Hearing Committee for a stayed suspension for a year and a day with two years of probation, Board imposed a private reprimand in 1997 and a one year substance abuse probation. Subsequently, due to Respondent’s failure to abide be the conditions of his probation, two revocation actions ultimately led the Court to impose a suspension of a year and a day in 2000. |
